These Terms of Service explain the rules for using nilohearing.com and its website features. The website is operated by WS AUDITION under the NILO brand. In these terms, “NILO,” “we,” “us,” and “our” refer to WS AUDITION.

Purchases are governed by our Terms of Sale. These website terms do not reduce the rights provided by our sales, return or warranty policies, or by applicable law.

2. Using the website

You may use the website to learn about our products, access guides, contact us and make purchases in accordance with our Terms of Sale.

Provide accurate information when placing an order or contacting us. If you use a customer account, keep your sign-in details secure and contact us if you suspect unauthorized access.

You must not use the website for fraud, impersonation, harassment or other unlawful activity; attempt to access another person’s account or private information; upload malicious code; or interfere with the website’s security or operation.

We may restrict access where reasonably necessary to address a security threat, unlawful activity or material misuse. Any such restriction does not remove your rights relating to an existing order, return, warranty claim or personal information request.

3. Product information and website tools

Product pages and guides explain the intended use, features and care of NILO products. Please read the labeling and instructions supplied with your product before use.

The Hearing Check, product questionnaire and website guidance provide general information. They do not provide a medical diagnosis or replace an assessment by a qualified healthcare professional. Product recommendations are informational, and hearing experiences vary from person to person.

4. Orders, returns and warranty

Prices, payment, order acceptance, delivery, the 45-day home trial and warranty support are explained in our Terms of Sale.

If these website terms conflict with a policy that specifically governs your purchase, that purchase policy takes precedence, subject to applicable law. Changes to these website terms do not reduce rights attached to an existing purchase.

5. Intellectual property

The NILO name, logos, website design, text, photographs, videos and other content belong to WS AUDITION or their respective owners and are protected by applicable intellectual property laws.

You may view the website and download or print product guides for personal use. Commercial reproduction, distribution or adaptation requires permission from the relevant rights holder, except where permitted by law.

Nothing in these terms restricts lawful quotation, fair use or your ability to share an honest review of NILO or its products.

6. Reviews and feedback

Reviews and feedback should reflect your own experience and must not contain unlawful content, impersonation or another person’s private information without permission.

You retain ownership of the content you submit. If you submit a review through a public review feature, you grant us a non-exclusive permission to display that review with the display name you provide through that feature. This does not transfer ownership of your content.

We do not prohibit or penalize honest reviews, including negative reviews. Private support messages are not treated as permission to publish a testimonial.

7. Third-party services and privacy

The store operates on Shopify. Certain features, including payments and WhatsApp, involve third-party providers. Their terms and privacy information may apply when you use their services.

Links to external websites are provided for convenience. We do not control their content or privacy practices. This does not remove NILO’s responsibilities to you as the seller.

Our Privacy Policy explains how we handle personal information and how to exercise your rights. Contacting us or placing an order does not, by itself, subscribe you to promotional emails.

8. Website availability and corrections

We aim to keep the website accurate and available, but temporary interruptions, errors or omissions may occur. We may carry out maintenance, update content or correct errors.

Corrections affecting an order are handled under our Terms of Sale. We will not charge a higher price for an existing order without your agreement.

Nothing in these terms excludes or limits liability for fraud, liability that cannot lawfully be excluded, or mandatory consumer rights and remedies.

9. Questions, disputes and applicable rights

Contact us if you have a concern so we can try to resolve it. This does not prevent you from making a complaint to a competent authority or bringing a claim before a competent court.

These website terms are governed by French law, without depriving consumers of mandatory protections under applicable U.S. federal, state or other law. Applicable law determines which courts have jurisdiction.

These terms do not require binding arbitration or a waiver of class-action rights. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

We may update these terms as our website or services change. The date above identifies the latest version. Changes apply prospectively, and we will provide additional notice or obtain agreement where required by applicable law.
